Ask Luigi App — Privacy Notice
Last updated: 26 October 2026
This notice explains how Viveur handles your information when you use Ask Luigi by Viveur, our app for iPhone and Android and our web app at askluigi.viveur.club (together, the “App”). Ask Luigi recognises Viveur products from a photo of their packaging and opens the product's page. This notice covers the App only. Our website and your Viveur Club account are covered by our Privacy Policy.
1. Who we are
The controller responsible for your personal data is Viveur Studio s.r.o., Na Folimance 2155/15, 120 00 Praha, Czech Republic. You can contact us about privacy at info@viveur.club.
2. The short version
- You can use the App without an account or sign-up.
- The App uses the camera only to recognise the product you point it at. We do not store your photos.
- The App contains no advertising, no analytics and no tracking, and we never sell your data.
3. What the App processes and why
Photos you take to recognise a product
The App uses your device's camera only while the App is open, and takes a photo only when you tap the
shutter button. The photo is sent over an encrypted connection to our server and to our artificial
intelligence (AI) service provider, which compares it with our product catalogue to identify the product.
We use the photo only for this purpose. We do not store it, link it to your identity or account, or use it
for marketing or advertising. Please point the camera at the product rather than at people.
Legal basis: performance of the service you request (Art. 6(1)(b) GDPR).
Technical data
Like any internet service, our server receives your device's IP address and basic technical information
(such as the time of the request) with each scan. We use the IP address only to prevent abuse by limiting how
many scans one network address can make per minute. This counter is held in memory for about a minute and
is not saved. Our hosting provider keeps short-lived technical logs to keep the service secure and working;
these logs do not contain your photos and are deleted automatically after a few days.
When the App shows product photos (for example when Luigi asks “Is it one of these?”), they load directly from
our shop's image servers at Shopify, which receive your IP address like any website you visit. The iPhone and
Android apps also check for and download App updates from our update provider, Expo, which receives your IP
address and basic technical information such as your device's platform and the App version.
Legal basis: our legitimate interest in providing a secure, working and up-to-date service (Art. 6(1)(f) GDPR).
Information stored only on your device
When you confirm that you are of legal drinking age, the App remembers this on your device so it does not ask again. The web app may also remember whether you closed the “add to home screen” tip, and stores its own files on your device so it starts quickly. None of this is sent to us. You can clear it by deleting the App or clearing your browser's website data.
What the App does not collect
The App does not ask for or collect your name, email, location, contacts, photo library or microphone, and it does not use advertising identifiers, analytics tools or tracking technologies.
4. Product pages and your Viveur Club account
When a product is recognised, its page on our website opens inside the App (on iPhone and Android) or in a new browser tab (web app). These pages, any cookies they use, and logging in to your Viveur Club account are covered by our Privacy Policy, not by this notice.
5. Service providers
We use these providers, who process data only on our behalf and under our instructions:
- Cloudflare, Inc. (USA) — hosts our server and the web app, and protects them against abuse.
- Anthropic PBC (USA) — AI image recognition of the photos you take. Under its commercial terms, Anthropic does not use these photos to train its AI models. It deletes them within 30 days, unless they are flagged as possibly breaking its usage policy, in which case they may be kept longer (up to 2 years) for safety review, or where the law requires.
- 650 Industries, Inc. (Expo) (USA) — delivers updates to the iPhone and Android apps (not the web app); receives your IP address and basic technical information about the App version.
- Shopify Inc. (Canada) / Shopify International Ltd. (Ireland) — hosts our shop, product pages and the product photos shown in the App.
Some of these providers are based outside the European Economic Area, in the United States and Canada, so your data may be processed there. Canada is recognised by the European Commission as providing an adequate level of data protection. For transfers to the United States we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses and, where applicable, the EU–U.S. Data Privacy Framework.
6. How long we keep data
- Photos: not stored by us; deleted by our AI provider as described in section 5.
- IP address for the scan limit: about one minute.
- Technical logs at our hosting provider: a few days.
- Technical data received by Expo and Shopify: kept by them for a limited time under their own retention rules.
- Age confirmation and other App settings: on your device until you delete the App or clear its data.
7. Camera permission
The App asks for permission before using the camera. You can turn camera access off at any time in your device or browser settings. Without it, the App cannot recognise products.
8. Age
The App features wine and other alcoholic products and is intended only for people of legal drinking age in their country. It is not directed at children, and we do not knowingly process children's data.
9. Security
All communication between the App, our server and our providers is encrypted (HTTPS). Access to our systems is limited to the people who need it.
10. Your rights
Under the GDPR you have the right to access your personal data, to have it corrected or erased, to restrict or object to its processing, and to data portability. Because we do not store your photos or link them to you, we usually hold no personal data from the App that we could identify as yours — but please contact us at info@viveur.club with any request or question and we will help.
You also have the right to complain to a data protection authority. In the Czech Republic this is the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), Pplk. Sochora 27, 170 00 Praha 7, uoou.gov.cz, or the authority in the EU country where you live.
11. Changes to this notice
If we change how the App handles data, we will update this notice and the date at the top. Significant changes will also be mentioned in the App's update notes.
